Its critics argue that there is a legislative usurpation, and even attack to the National Congress Sovereignty. However, there is a strong theoretical debate about the prevalence between the Principle of the Congress Sovereignty or the Principle of Constitutional Supremacy. This paper's aims is to develop both principle's concepts and situate the Brazilian case on the debate. Nos ultimos vinte anos, e cada vez mais recorrente o protagonismo do Supremo Tribunal Federal em questões politicas. Seus críticos argumentam haver usurpacão de competências legislativas e até mesmo ataque a soberania do Congresso Nacional. Entretanto, há um forte debate teorico sobre a prevalência do Princípio da Supremacia Parlamentar ou do Princípio da Supremacia Constitucional.
