The Brazilian Supreme Court's protagonist role on politics has been recurrent in
the last twenty years. Its critics argue that there is a legislative usurpation, and even attack
to the National Congress Sovereignty. However, there is a strong theoretical debate about the
prevalence between the Principle of the Congress Sovereignty or the Principle of Constitutional
Supremacy. This paper's aims is to develop both principle's concepts and situate the Brazilian
case on the debate. |
